Use, work request and publication conditions

Updated 23 October 2026 · Version 2026-10-24.1

For artwork sales, the artist is the seller and issues the invoice. Aktif Sanat takes no commission; it informs artists of artwork enquiries and processes the necessary contact data for that purpose. The artist and buyer handle the artwork contract, payment, delivery and invoice directly. The provider and conditions for courses, publications and website services are specified separately for each transaction.

These terms describe Aktif Sanat’s current membership, artwork, request, course, publication, gallery and community services. Operator/contact information appears in the privacy notice. General terms do not replace transaction-specific pre-contract information or a sales contract, and do not restrict mandatory consumer rights.

1. Membership and artist accounts

Membership is free. Choose your password during registration and use your account immediately. Artists must verify their email before submitting their profile for administrator approval. Provide accurate information and protect your password. Members use favourites, requests, comments and forums. Artists edit only their own profiles and artworks; publication and changes require administrator approval.

New artists must supply a profile photo, short profile, CV and Instagram; awards are optional. Submission for publication requires at least three artworks with complete details/images. Existing artists are exempt from this new threshold. Administrators review records within their authority; only the site administrator changes gallery arrangements and music.

2. Art, course and service requests

Submitting a request alone is neither payment nor a final sales contract. Management confirms availability, price, seller/provider, delivery and payment. “Request a price for a commission” does not mean free. Card charging and automatic subscription renewals are unavailable.

Before payment or contract formation, seller/provider identity and contact, characteristics, total price including taxes/extras, payment, delivery/performance, complaints, withdrawal and returns must be clearly provided on a durable medium. Do not pay until these details are complete. Course pages state dates, durations and fees; changes are communicated to participants.

3. Bank transfer, codes and history

“Payment made” is a declaration checked against bank records. A publication code is created only after payment approval. Requests and replies appear in your account. The account/publication-specific code lasts 30 days and is used once; the authorised publication can then be downloaded from your library. Code expiry does not extinguish rights to paid content; ask for support.

4. Withdrawal and complaints

Consumer distance contracts generally carry a 14-day withdrawal right, subject to statutory exceptions, starting on delivery of goods or conclusion of a service contract. Send withdrawal, refund, termination and delivery requests through account feedback or contact channels; if you cannot access your account, use the postal address in the privacy notice. Include the transaction reference and request.

Exceptions for bespoke goods, instantly supplied digital content or services started with consent apply only when the particular legal conditions are met. Artworks and courses are not all automatically non-returnable. A tick or code use does not universally waive all rights. Rights concerning defective goods/services remain. You may apply to the competent consumer arbitration committee or court under the applicable requirements, including mandatory pre-action mediation where relevant.

5. Auctions

Bids require administrator approval; no automatic charge occurs. Times, opening price and minimum increment appear on the auction page. Management confirms the outcome and payment/delivery after closing. Pending bids do not guarantee winning. Calling an event an auction does not remove statutory consumer rights or pre-contract information duties.

6. Copyright and publications

Uploaders must have sharing and, where relevant, selling rights. Uploading does not transfer copyright; it permits use necessary for platform promotion, exhibition and request/access services. PDF/cover publication requires a rights declaration and approval. Unauthorised redistribution is prohibited. Published art images may technically be copied by viewers, without granting legal permission. Report infringement with the content link and explanation.

7. Community and outside services

Artwork/artist comments require artist and administrator approval; blog/forum posts require administrator approval. Harassment, hate, spam, misinformation and rights-infringing content are prohibited. Management assigns community ranks. The calendar is selective: check organisers for current conditions. Free resources are not necessarily openly licensed. External shops and social platforms have their own terms.

8. Account and changes

You may export data, request removal and delete your account. The privacy notice describes retention, backups and rights. Content/access may be restricted for security or rights violations; you may request review through support. Terms changes carry a date/version and do not retrospectively remove acquired rights in completed transactions. Accepting terms is not consent to marketing or every processing activity.
