Copyright, artwork sales, and digital publishing
Distinguish the artwork from the rights in it
Copyright can arise when a work meeting the legal requirements is created; it is a misconception that registration is always required to obtain rights. Transferring ownership of a painting does not automatically grant permission to reproduce and distribute its image for every purpose. Keep source files, dated process records, and correspondence for your own work in an organized archive. This module provides general education; a specific dispute or contract requires advice from a qualified legal professional.
Attribution is not the same as permission
Being able to download a photograph, text, or drawing from the internet does not give you the right to include it in a paid publication. Attribution matters, but it does not by itself make every use lawful. Is the content yours, do you have written permission, is it covered by a particular license, or does an exception apply to the specific use? Check these questions separately. If an open license applies, read its terms on commercial use, modifications, attribution, and sharing under the same license. Record the license version and the date you accessed it.
Prepare a rights record for a digital publication
When preparing a PDF, list the cover photograph, illustrations, translations, and other contributions as well as the main text. Record the creator of each element and the basis on which you may use it. In a collaborative project, make responsibilities, permitted uses, and revenue sharing clear in writing. Include readable publication details, a contact method, and terms of use in the PDF. Buyers should be able to understand which file and version they are being offered, and for what use. Checking a permission box does not create rights you do not actually hold.
Make pricing and delivery specific
When setting a price, identify costs such as materials, production labor, external services, packing, and any commission. Tax, invoicing, and international shipping obligations vary with the person and transaction, so clarify them with the appropriate professional. Tell the buyer what the total price covers, whether shipping is included, the dimensions and medium, the condition of the work, and the estimated delivery time. For commissioned work, set out the permitted changes and approval stages in advance. Keep prospective inquiries separate from confirmed orders in your records.
Separate inquiries, payment claims, and approval
A user checking “I have made the bank transfer” does not mean that payment has been verified. Track the inquiry, payment check, administrative approval, and delivery as separate stages. An authorized person should verify the transaction records before the artwork is released or PDF access is granted. Clearly tell the buyer which stage has been completed. If card payments are not enabled, state this visibly and do not ask for card details. Collect only the personal information needed for the inquiry and do not share it with other buyers.
What will you learn in this tutorial?
- Distinguish the physical artwork from permission to exercise copyright
- Record the rights status of third-party content
- Organize pricing and order information in a clear inquiry record
Workshop application
Make a rights and sales record for one work
- Choose an artwork or short PDF of your own and list all the images and texts it uses.
- For each element, record “my own work,” “written permission,” “license,” or “needs research.”
- Write the artwork description, what the price covers, the delivery method, and the estimated timeframe.
- Use a sample record to distinguish inquiry received, payment being checked, approved, and delivered.
A list of rights sources and a transparent sales or inquiry record; no real payment is taken.
Evaluate yourself
Can an image available online for free be used freely in a paid PDF?
Not automatically. You need to investigate the rights holder, license, permission, and rules that apply to the specific use.
Is a declaration that a bank transfer has been made enough to proceed with delivery?
No. A payment declaration and verification by an authorized person are separate stages.
Materials you will need
